It sounds like IV should assign PD to people who join and accordingly allow them to comment.......just like USCIS allot GC based on PD.....:)

The primary reason for the slow movement is due to the following reasons
a) change in the namecheck policy. Sometime during early 2008 USCIS changed the rule for all cases stuck in namecheck for more than 90 days. Around 215k cases (family + EB) were stuck in namecheck this caused a flood of eligible cases. (i was stuck in namecheck for almost 3 years, i know what i am talking about)
b) USCIS changed the overflow rule. earlier EB3 would get more of the unused visas, now most are consumed by EB2 I &C. since there are no additional visas available for EB3 (with no chance of getting any till EB2 is cleared) the EB3 queue has very little chance of moving rapidly. Maybe USCIS did this to drive a wedge in the community, whenever we bring this up there is a slew of red and green dots :p
recapture was the best bet for everybody, one time recapture of the 300k odd visas will reduce all wait for all categories....will it happen..probably not.
They recaptured unused Visas once, somewhere in 1997 I'm not sure exactly when it happened, but that took care of the backlog then.

In the year 2001 Clinton Administration gave Amnesty to Illegals, they were given opportunity to file their 485s with PD of April'2001...Now this is controversial, as I have even asked few lawyers about which categoy they fell in ? Some says 'EB-3' other says 'Other Workers' Category.
If it is EB-3 you know the answer why the dates haven't passed the big hump of 2001 in last 4 years...

When ImmigrationVoice present their case they would present their logic,
arguments and facts which they have.
Then it is for lawmakers to decide who is more convincing and
what is best for AMERICA and its people

backing from the experts, which we have, we shall be heard.

well, the question then would be, has anyone been denied after presenting an EVL which states the employee is a consultant ?

I am in same situation who has sept 10th ND from TSC , no FP for me or my wife. I did open a SR and i got a response letter saying that either your FP has expired or clearance has not been received.. will send one by mail soon.
It has already been 45 days since the letter was dated. NO FP nothing.
Has going to IO helped anybody is getting a FP notice? That seems my last resort.
No update from my side. I had called last week and week before that. Apparently I got the same IO the last two times and first time she told me no FP scheduled , security check cleared. Second time she said no FP scheduled and I asked about security check and she said its still pending. Imagine same IO giving inconsistent information regarding my security check. I am not even sure to believe anything they say anymore. I am not even sure if they really look it up or not.

Dividing IV on the Lines on EB2 or EB3 or on basis of ROW/India is something i just dont like. United we stand !!!!!! .
I saw couple of threads earlier from you which talks against porting of EB3 to EB2 - i believe you had some lawsuit idea there for not allowing BS+5 to port to EB2 which is think i highly divisive and unfair on certain peoples
Lets come up with ideas without stepping on each others shoe and i'm 100% willing to join.
Here is what I propose:
1. Any one with good english language skill : Can you please volunteer to draft a letter stating the issue....
2. Please contact your lawyers to see if they have contact in AILA.
3. Please contact you state chapter leader to discuss what can be done from IV stand point. I live in tri state and will contact. Murali or Chandrakanth

Mine was a EB2 India, Feb 2006 PD. I was hopeful in the month of august, but then I had lost hope because everybody was saying visa numbers got over. However, surprisingly they approved the case in September. Looks like CIS has many aces ups its sleeve. It never fails to surprise us.
Also, I received only one soft LUD on my application, then suddenly it is card production ordered.. wow.

We, people with EB3-I priority dates in 2002 2003 2004, should not blame others for our problem. The only way out of this mess for us, I think, is to port from EB3 to EB2. We all need to do it before they scrap that law. We are being too loyal to our original employers. Most of us were working for more than 8 years in the same company. It is time to move-on and search for greener pastures. We checked that there are around 20,000 EB3-I applications in front of us. That, @ 3000 applications per year, means more than 6 years of agonizing wait. We are already waiting for 8 years and I don't know whether we can take 6 more. I think only a mass-porting from EB3 to EB2 should be the answer.

I got some good news. I called uscis just now and got two receipt numbers, one for 485 and one for EAD. Checks not cashed yet. I don't have the receipt number for AP yet. So it seems that our box is not lost and they're processing them, though so slowly. My application arrived on 7/3 at NSC, received by R. William at 9:03am.
Hope every one of us will receive our receipts, EAD and AP asap.
Going by the most recent receipting update, very likely, our cases (especially July 3/R.William) got transferred from NSC(well beyond 07/03) to TSC(beyond 08/05 - the LUD date) to CSC(still working on 07/30). If you have a counter example, please post.

I landed in Jan08 thru Windsor border in Michigan. I drove in my car to CA. You'll go to the immigration officer who'll check your landing docs, and then ask you to sign the landing document. Then show them the proof of funds. I had a cashier's check for the amount. Then you'll be asked for an address in CA. If asked tell them you are planning to settle at the address. If you say you are returning to US, they'll not give you the PR card saying when you come to live in CA they'll issue it. I made that mistake. They stamp your passport with the entry stamp. Without a PR card you can't enter CA at an airport. Your only option is driving to CA thru a land border. They'll let you in with just the stamp on the PP. Fortunately I live close to Windsor border.
As someone pointed out, you'll then go to customs, where they'll check the goods you are bringing or plan to bring later. There are 2 different forms for 'bringing goods with you' and 'goods to follow'. Make sure you fill in all the item in your home on the 'goods to follow' with some details like model number, etc. If you are not planning to live to CA, don't fill anything on the 'bringing goods form.

Now I have no idea how difficult or immpossible this would be, as I had always been EB2, but their are several threads on this forum that can assist you. I strongly suggest you to seriously start researching your way out of this mess. I wan't expecting EB2 to stay beyond 05, but it is going to be like that for another month. Are all the 2004 EB2-I applicants exhausted? ... I don't know, but I know EB3 just keeps on retrogressing.
If this abyss continues, think about it ... you will always remain struck where you had been for past so many years. This is no life.

It already does, if you have an approved I-140 based on your LC.
For old PD, pending I-140 should not be bottleneck.
PD should be first criteria but US experience should not be ignored completely. US experience should be giving less point then PD.
